This is a spin off from Jen's posts. I am cross-posting part of a message by Tammy Falkner regarding rescue:

"The lawyers have told me that in the state of NC, only animal control can pick up strays. If you see a stray in the street, you should KEEP DRIVING. This goes against absolutely everything that I believe in, but I have been assured by multiple officials that this is the case. I even spoke with the guy that wrote the book on animal law in NC for the government. He said that if you pick up a stray, even if you place it in a good home, you must return the dog if the owners so desire. This could be years later. If the owners want the dog back, you must return it or you could be charged with larceny. Amanda Lamb with WRAL tv 5 did a story about it today. She researched it for a week and came to the same conclusion. IF YOU ARE NOT ANIMAL CONTROL, YOU CANNOT PICK UP STRAYS."

Tammy Falkner has a website for Falkner Animal Rescue and Recovery and is very instrumental in rescue and adoption in Louisburg, NC.
Again I applaud Jen's effort. NC law makes it very difficult for individuals and/or rescue groups to operate.

Yep Totally true... the beginning of the summer my son found a family of feral cats back in the woods a mother and 4 babies ... I began trying to catch them so that i could find them some homes before they got hit in the road ... i sat a crate outside and put some yummy kitty food in it and eveything ... well finally i saw one of the kittens dead (my worst fear) in the road. I called animal control and they told me since i attempted to feed these animals then they must be mine... and i better get their rabies shots done because it was aganist the law to have them roaming without the shots <IMG SRC="http://dachsie.org/ubb/cwmsmilies/cwm23.gif" border=0> I tried to tell him they werent mine i was trying to catch them so i could bring them into the no kill and he said that if they were strays i SHOULD NOT feed them and if they died in the road basically that was NOT my problem <IMG SRC="http://dachsie.org/ubb/cwmsmilies/cwm4.gif" border=0> Long Story short... he set a trap and only the mother showed up they took her to the KILL shelter in Guilford co. and who knows what happened to the little babies who were about 4 or 5wks old http://dachsie.org/ubb/smilies/frown.gif i havent seen any of them ... i blame the ACO ... when it comes to animals NC SUCKS! Lately there has been a basset hound mix roaming around with a half cut off infected tail... i have tried to catch him ...i dont care what they say ill feed him ... and then ill take him to the NO kill and they can kiss my butt! http://dachsie.org/ubb/smilies/kiss2.gif

Good God, what an asinine law! And what, exactly, is the point of it?! How can they be so bloody callous and idiotic? Okay, now I'm getting really angry . . . .<IMG SRC="http://dachsie.org/ubb/cwmsmilies/cwm4.gif" border=0> I am soooo tired of dealing with idiots. I've reached my limit. I need a body bag that I can pummel the hell out of while I think of various poloticians and ACO's! Grrr! I really need to calm down.

I know, it is asinine, insane, and infuriating! It reflects the common attitude, "It's my dog and I can do anything I want with it...butt out!"
It makes rescue/adoption a slippery slope in NC.

I haven't seen it yet, but the synopsis mentioned that if you pick up a stray you may be in big trouble. How silly! And definately detrimental to rescue. Roxane, how can you all get around that? Better yet, how do you handle it?

When I first became interested and involved in rescue it was with a different breed. I was affiliated with their national association doing purebred rescue for 8 to 10 yrs. Being backed both financially and legally (by the assoc.) I never gave these issues a second thought.
In addition, through listings I posted, most of the adoptables I found homes for, came from shelter contacts. I also personally dealt with a few owner turn ins.
In all instances I had release forms.
Now, with two dachshund rescues of our own, I have done some research and have been unable to find any organized Dachshund Rescue in _Western_ NC. I have shot emails out, with inquiries, without success. Part of the reason may lie with the law, no one wants to put themselves in legal jeopardy.http://dachsie.org/ubb/smilies/uh-oh.gif I have also been told, more than once, that shelters in this area, do not list their dachshunds. They find they are very easy to adopt out therefore they advertise the larger breeds.
Ideally, I would like to be a part of a recognized organization that concentrates it's effort _in my area_.
Otherwise, to answer your question, as an "independent", I would follow the law and take a stray to a shelter IF they would assure me that the dog would be released to me, after their stated legal period of time. If I did not have that guarantee, what I _might_ do is not for publication. To me, an orange jumpsuit does not make a fashion statement! http://dachsie.org/ubb/smilies/rolleyes.gif
If, Mary, you are fortunate enough to have a dachshund rescue group where you are, and you want to be involved, that would be the place to find better answers than I am able to provide. We have both DRNA and CCDR members on this board, I am sure they would love to hear from you.

As for it being long . . . .I tend to be a bit verbose myself. Can't help it; it's part of my genetics.
Anyway, I am part of DUR and do home checks for DRNA. I also want to get involved in trans for CCDR and Andrea and I have discussed it. I try and find ways around things, but have realized I look "washed out" when I wear orange so I try to stay awy from that color <IMG SRC="http://dachsie.org/ubb/cwmsmilies/cwm42.gif" border=0>
DRNA isn't in your area? I wonder why. That seems awfully odd. The shelters around here aren't very good at working with rescues no matter the breed. I'm pushing the one in my county along with several other rescuers to notify us when they have pups who can go into rescue. They are getting better . . .they even have begun to notify pit rescue! Hello,
Just another idea of how to protest the situation in NC. I visited their tourism web site and filled out the guest book at http://204.211.63.201/site/dynamic.stm?doc=frame_prox_form&body=giventake_book and told them that while in the past I had thought NC was a state I would like to visit and had even considered looking for a job there it was now off my list of places I wanted to go. I explained that their backward animal rights laws were the cause of my change of heart. Perhaps if more people would let the tourism department know that their backward laws may be keeping dollars out of the state then they will start to put pressure on the legislator to make changes.

Another thank you, Tom. Are you sure I don't work for you? You keep supplying links and I keep writing letters. I guess since most of the letters, recently, involve issues in my state, we really can't discuss salary, can we?
BTW what is the latest on Wyoming?

The last I heard Wyoming was waiting for the next court date. I do a lot of web searches trying to find answers to problems at work and thus have learned how to use most of the search engines to their best advantage. I'm not sure how the tourism idea hit me this morning but it took less than two minutes to find the page I posted. Some days my jobs involves a lot of 2-5 minute waits for something to complete before I can go on so those are they days I do more reading and posting from work. Some other days I don't even get to check out what's new.
I like to think that in some small way I'm helping out some of our friends in need by point people in what I hope is the right direction. You're never sure of the sites you recommend but I figure if the people at the other end care enough they can check out the details.
