and a fine for drowning his dog at Jones Beach (which is in NY, Long Island- not far from me)
He should have gotten MORE but I'm glad he got some time.

I thought when I heard the intial story months back, is that people were at the beach and no one stopped him for a while! Huh...what's wrong with that picture!

These articles are about Noodle. Tina Mulvey a member of Almost Home has been at every court case against this "b......" Tina was able to convience the court to give her Noodles Ashes so she could have them buried.
Such a sad story, but at leaast he was given some jail time.

very angry at the decision. Honestly, considering this type of stuff and WORSE goes on all the time (just we don't know them all) and people get off totally, this is some type of justice. JMO though.

What a terrible way to treat a pet! I can't imagine the terror that dog must have felt- being slowly and mercilessly dunked into the water by someone who should have loved him. I get so frustrated by these kinds of cases- they'll never be punished as they should be, but as you say, Loren- so many cruel things go on every day that never even sees a day in court. It's just heartbreakingly sad.
And what were those onlookers doing?? That little jerk- I could have (and sure would have!) taken him down myself! If his 45 minutes of dachshund dunking "horrified" onlookers- then WHY did they let it happen?? People need to learn to speak up and take action when injustice happens. I'd much rather risk making that ignorant, cruel man mad than have my soul branded with the vision of that creature's suffering!

At least they gave him some jail time, but he needed a lot more community service -- working at the animal shelter! I know how upset Tina was, but at least he didn't get off completely like many do.

Proving once again that the laws need to be strengthened to protect animals. As Rena said, at least he got SOME jail time for his evil actions...but there has to be strict punishment, and a lifetime ban on owning an animal ever again.
I love what San Fran has done - you are a GUARDIAN of an animal, and as such hold the responsibilities for that life! As we all know, you can't OWN and animal....but you can have the pleasure and joy of being the guardian of that soul.

This man deserves a life sentence for this horrible cruel act. What shocks me is bystanders watched him as he kept dunking Noodles for as long as 45 mins? If I was there the jerk would be toast, plus he would be minus a dog as I would take the poor thing away from him. Maybe I would dunk him for an hour!

but what about humans, babies that get treated this way EVERY SINGLE DAY..many get off, or a slap on the wrist, some don't even get what this guy got!
Not to make light of this scenario, but stricter laws for humans too!
ITA with all!! What were those bystanders doing??? He definitely needs more jail time, more fine and most of all deportation!!! :mad: :angry: :mad:
The Animal Defense League is working to change laws but it will take time.

but, what are the odds? San Fran is a role model the rest of the country should be following, but how realistic is that? It comes down to people 1) are not being taught to respect ALL life, whether human or animal, and 2) are also taught not to get involved.
It makes me ill to think of those "bystanders" gaping in "horror" and not doing a bloody thing about it. I'm with the rest of you all; I would've clocked the guy upside the head and pinched his dog. I have zero tolerence for any type of animal mistreatment by humans. We are their guardians and for many of us they are our children. It is up to all of us to write to our state reps and keep on top of animal laws currently under consideration, so that we may act before they (gov) slip another shoddy law into place. We need to be loud and forceful in order to protect the ones we love, whether that be human and/or animal. It's our job to protect them...and we owe it to them to respect their lives enough to fight for them.

another story on Noodle and this one says he got Community Service and probation.. Tina got her 2 cents in too, but If *I* got my 2 cents in, I would be saying he needed a little more than just education!

Jailed for drowned hound

A Queens man who drowned his dachshund at Jones Beach last summer was
sentenced yesterday to 15 days in jail.
Hundreds of beachgoers saw Yoichi Nakayama pushing the struggling pooch
named Noodle into the surf over and over on Aug. 4.
Finally, with Noodle limp in his arms, Nakayama walked out of the water
and started to dig a hole to buy the dog, police said. State Park police
arrested him on an animal cruelty charge.
Nakayama, a chef at a sushi bar, pleaded guilty to the charge, but before
he was sentenced, his lawyer insisted he didn't intend to hurt the dog.
The attorney, Sheldon Glass, told Nassau County Court Judge Joseph
Calabrese that Nakayama was merely playing.
Still, Nakayama apologized and told the judge he was ashamed of his
actions.
"Your conduct was serious," Calabrese responded. "And, of course, you
caused the death of this poor dog and shocked everyone in the area."
In addition to the jail term, he ordered Nakayama to pay a $1,000 fine
and perform 125 hours of community service. The judge also placed him on
probation for three years.
Tina Mulvey, a member of an animal rescue group that monitored the case,
said Nakayama "needs to be educated."
"You don't take a dachshund to the beach thinking the dog will swim," she
said. "Those little legs can't paddle."

HE didn't intend to hurt the dog? Yeah, right. Geez, lets see if we held him down in water for 30 minutes , mmmm, what would happen?
